Sometimes it's HOW you do things rather than what you're actually doing.

In wealthy areas or in the entertainment industry, you don't have people hanging out on corners acting like morons selling their drugs or walking around wasted and annoying everyone else, stealing from bodegas and grocery stores to get money for their fix. begging people for 'change', or prostituting themselves.

They put themselves out there, drawing all kinds of attention to their illegal activities. They do everything just short of holding up a neon sign that says "HERE I AM, I'M DOING ILLEGAL STUFF, ARREST ME!"

I've yet to see anyone selling loosies in wealthy areas.

Because the transaction and use likely all occurred within the confines of a private residence. Garner should of been more shady and kept his illegal business activities off of other peoples properties. What a dumb comparison.

The problem with Nywriter's theory is that he is seizing upon one tragic story to paint a false picture of the justice system.

Not every - or even a noticeable percentage - of minority criminals who encounter the police are killed, injured, or even sent to jail at all. On the contrary, just like every other race, when arrested for low level crimes, minority perps overwhelmingly receive desk appearance tickets, ACD's, time served, etc. Anyone who tries to debate that fact has clearly never spent a minute in an arraignment court part in NYC.

As others have said, the Eric Garners (not GarDner Nywriter...) of the world blatantly conduct their illegal activity right out in the open where everyone, including cops of course, can see them, while the Phillip Seymour Hoffman's of the world hole up in their fancy apartments and art gallery functions to stick needles in their own arms.

Even if they did do that Garner had been locked up on similar charges two or three times recently and had cases pending against him for the same crime. NYPD knew who he was by name, his "widow" spoke of that in her interview with Meet the press. How many passes are the NYPD supposed to give the same guy for the same crime?

The store merchants were fed up with him disrupting their businesses, the Cops were under orders to get quality of life criminals off the street. Every variation of this story comes down to the same conclusion. Garner was an unhealthy, known criminal who was over weight, very unhealthy got himself worked up when he resisted arrest and died. That's how anyone with a logical mind including the Grand jury saw it.

A lot of fashionable, mostly white nightclubs full of well off people, when people want to get high off coke they go in the bathroom and snort. And they rarely get busted and certainly aren't killed by the cops. Again, they are getting high in a private establishment. The nightclub owners need to enforce their policy not the police dept.

According to the NAACP's Legal Defense Fund, there have been 74 "unarmed victims of color murdered by police" since 1999, or nearly 5 per year. Their list is pretty dubious, since it includes several people killed by security guards and not police, includes all deaths whether or not they were self defense by the cop, etc. It also includes all deaths, not just gunfights, including vehicular accidents, etc. But for the sake of argument, let's not parse out the numbers and stick with that 5 a year.

According to the FBI, do you know how many arrests there are in the USA per year? Over 14 million. I was stunned by that number, but it's a solid FBI number collated between 2004 and 2009. 14 million + per year. That means there is an "unarmed person of color" killed (and remember, not all of those are unjustified) per every 2.8 million arrests. If we tossed out the self defense, the ones that weren't actually killed by cops, etc. the ratio would continue to go up.

There are some weekends in Chicago where more than 74 are shot in black on black violence.

Oh no, it's still illegal regardless of where it's done and the police department is perfectly capable of sending undercovers in those places. They don't though, because they do not target well off white people.

Some of those people are out protesting his death. But even for those who don't care, they are still dealing with Gardner types and as the supplier of money/purchaser are clearly the source of the problem.

And that's the bottom line, cops do not target those with no money.

If the nightclub owners are not complaining, why would NYPD send undercops?? People doing drugs, etc also happens in minority nightclubs.

Did Gardner resist arrest? Did you see the video?

After the cops took him down, all they had to do was back off him when he said he couldn't breathe and immediately help him. How are the cops to know that is not a ruse? Every time a criminal states the handcuffs are too tight, a police office should un-cuff them and hope for the best. Eric should have not resisted and allowed the cops to arrest him like a professional criminal with 30 prior arrest under his belt.

They didn't and now he's dead. This does not happen to well off white people. Well off people of every race are not committing illegal activities out in a public setting.
