This is absolutely infuriating, but I believe it. I lived through the exact same situation back when I had to share an apartment where I was the only leaseholder. I had a POS from Missouri living for free during 6 months and I had to spend thousands of dollars to get him out of my apartment. NYC will burn you if you are an honest person trying to make a living. I rented out a room in my apartment and he stopped paying me. I was not even a "landlord", since I was only a leaseholder, but to NYC judges, I was a "landlord". BS. It was not until I became a total psycho against the parasite that he got so scared he left. The victim in this article says "“This could happen to a tenant who has a roommate". Yup, it COULD AND IT DOES. It happened to me.

Cops are so useless to law-abiding citizens that they even escort squatters and protect the criminal element over the taxpayer and people who try to do things right. I know exactly what this woman is going through with that squatter. In my ideal country, squatters and other parasites would have it so bad that they would be terrified of even attempting to do this. Unfortunately, NYC is a paradise for criminals and illegal immigrants.

Word of advice for people in this situation: if you can get out of the apartment, make sure to switch off all utilities like electricity and gas not under the tenant´s name and wifi too. Under NY laws, tenants are not entitled to electricity or gas in the kitchen. If at all possible, remove the fridge and the stove. I had to take proactive steps like that to finally have the Missouri redneck removed from my apartment. The marshal came, but by the time he came the squatter was thankfully gone after my "talk" with it...err, him.

So she stopped paying rent AND vacated the premises for several weeks but was still presumed to retain a leasehold interest in the property? What kind of messed-up laws are these?

New York laws, courtesy of the crooks in Albany. Laws are rigged against honest people in this country and especially in NYC. What else can you expect of a city that doesn't allow border force/ICE to do its job and where criminals can stab someone in broad daylight and walk out with no bail?

I'm surprised people still have to pay for stuff in shops at this point rather than just stealing it and then say that if you make them pay it is racist.

It's not illegal to rent out an extra bedroom in your own apartment. It's called having a roommate.

Some coops may have restrictions about roommates, but the article didn't mention it, so not seeing where you're getting that it's an illegal short term rental.

I shut down all the electricity (it was under my name and the deadbeat did not have a penny to his name except some welfare checks he got from NY State for food). I then took out the stove (it was easy to take out since the stove was one of those portable electric ones in the shape of a rectangle). I also took out my microwave and had the fridge removed and put in a storage facility. I am lucky in that I always have a place to go, unlike the deadbeat.

Police told me that as per NY laws, I obviously could not shut off the heat or hot water (which I did not) and that I could also not deny him usage of the bathroom (which I did not). Everything else was totally legit. I also shut down the wifi and cut any cable source. Since wifi has to be installed under your name, he could not get wifi either. He went to a cafe across the street (I noticed he went) so I went to the cafe, showed them his picture and warned them that he was stealing wifi (which is illegal). They quickly changed the password.

Lastly, I had cameras installed in all the communal areas. He told cops that I had cameras and cops laughed saying "sir, he can film wherever he wants in this apartment except your own room or the bathroom". The most hilarious thing was this: "I ALWAYS HEAR HIM TALK BAD ABOUT ME ON THE PHONE!!". Yes, because when I was in the kitchen I would call my attorney or anybody I felt like to discuss what a POS he is. Cops also told him there is nothing they can do about me talking on the phone in my own apartment as long as I do not go into his room.

He was almost arrested the second time he called police because he insulted an officer and was threatening. They were going to arrest him for filing a false police report. He quickly changed his tune after that. Things got so bad that he would randomly call inspectors claiming there was no heat in the brownstone (there clearly was and inspectors would leave immediately). Then I would blast my music at 4am, or 5am and since I did not have to sleep there, it was OK. I would make random noises...in the kitchen, etc. Nothing he could do about that either.

He finally became desperate, so desperate that he left just a few days before he knew damn well the Marshal was on the way to throw away all his crap and boot him out of the apartment. He left nothing behind and thankfully I was there on a daily basis to make sure he did not destroy the apartment.

Another variety of scum that should be in jail, instead of being protected by a fake law.

Don't get angry at the police. They are enforcing the law, that's their job. The Court ordered and allowed her return. The police were there to prevent violence and ensure that the court order would be enforced peacefully. Protest to your representatives in Albany and City Hall who make these laws. Congress and the Assembly make the laws; the courts interpret the laws, and the police enforce the laws.
