I need to file a small claim (less then 500.00) against somebody in Monroe County and I am unsure how to do this...Any help will be apprediated THANKS

you have to go to your district court, and ask them for the paper work to fill out, pay the filing fee...and there you go.

Red face here's some general help re small claims

You have to find out who your local magistrate is. If you don't know, google it. Go to the magistrate's office (here in Scranton, my local magistrate closes around 3 or so...which I think is early for us working folks...so be sure to find out closing times). They have forms for you to fill out with the information as to your claim; the fee is based on a sliding scale according to what you're saying the damages are. You'd be wise to have copies of all receipts applicable. And that's all there is to it. Then, just wait till they notify you of a date. Good luck!

AFAIK You have to file in magistrates district where it took place. For example in my coal business since the business end of it was entirely conducted at their home I needed to file in the district where they resided.

Last time I filed it was set fee, I think it was $50. That would be included in the judgment if you win so it shouldn't cost you anything if you win.

True, you file the complaint where the offense occurred, which is not necessarily the magistrates district where you live.

I have used the magistrates for my rentals/tenants, my experience is you win.....but you win nothing....good luck...if its anything that you can file with the police, I recommend you go that way...criminal vs civil
