Sorry I couldn't clarify the details of her lease better. All I know is that my SIL got a signing bonus AND gets monthly lease payments. Royalties haven't kicked in yet because drilling hasn't started. Her monthly payments are substantial. When she got involved in this, the family had mixed feelings but it seems that it has worked out well for her.

yeah, i'm still puzzled by these monthly payments...but, if she's happy, then that's all that really matters!

Default Range in Southern Beaver County

I have 37 acres in hanover Township, Beaver County. Last week I was offered $ 2.220 per acre for a five year lease and seventeen percent royalty. I was told that most likely that no drilling will happen in my area for three years as nearby Racoon Creek State Park is about to be signed ( through the state ) to allow drilling. That is about 8,000 acres all told with adjacent property. So Range's attention and resources will be there for the next few years in that part of Beaver County. But, they are signing the leases never the less.

Yes. Since you're not the one getting any royalties and therefore not signing a lease, they can't do any surface activity on your land.

I wouldn't worry about looking that up yourself if it gets difficult. The gas company has tons of people that do it. If you don't own the rights, the contract is nullified.

Sounds like you were in the CoExprise Mt. Jackson group. I was in that group but our area didn't get included in the offer.

We've since been offered $3K per acre + 15% royalties by Rex Energy.

To summarize a complex area of law, in Pennsylvania the owner of a mineral estate has an implied right to use the surface to access the minerals, but must try to reach a reasonable accommodation with the surface owner, and is strictly liable for any damage.

Land Owners and Oil and Gas Leases in Pennsylvania (http://www.dep.state.pa.us/dep/deputate/minres/oilgas/fs2834.htm - broken link)

My family has quite a bit of mineral rights in PA, but we don't own the land, just under it. Range is paying money just to have an option. They are banking on a boom time here and trying to control quite a bit of land. Hope it works out for them. I know many large parcels are just tied up and not being developed. I have a feeling the Range will be purchased by a big energy company if this pans out, but that is just speculation.

Range just offered a few more bills per acre for Hanover Twp, Beaver County. $ 2,500 per acre, 17 percent royalty on a five year lease. ( for those that own the mineral rights )

So they are paying $2,500 per acre and 17 percent royalty if they develop? Is that a standard in Beaver County? Does that apply to say... Butler County or Forest County? Also, the $2,500 per acre, does that mean the person owns the land as well as the mineral rights to get that much. Wonder what the split is if a person only has the mineral rights? Does the land owner get a certain percentage?
