There is just two many variables in the question and the target votes.

"The damage has already begun"

Repeal of ObamaCare can't come soon enough -- as several damaging provisions are set to take effect this year.

For starters, it has effectively stopped the construction of physician-owned hospitals throughout the country.
Of course, patients may have trouble finding not just a hospital, but a doctor. A Physician's Foundation survey revealed that 40 percent of doctors plan to "drop out of patient care in the next one to three years." Sixty percent said ObamaCare will "compel them to close or significantly restrict their practices to certain categories of patients" -- typically those on Medicare or Medicaid.

Health reform will force many folks to give up their current insurance, too
Other measures kicking in are petty -- but punitive. For example, people can no longer use tax-free Health Savings Accounts on basic over-the-counter drugs. Instead, they must pay for a doctor's appointment -- and then get a prescription for a pricier pharmacist-dispensed drug.

Actually there is no such thing as an automatic appeal to the Supreme Court. The Supreme Court picks the cases it wants to hear, and ignores the rest, so if the 11th Circuit Court of Appeals affirms the lower courts ruling and the Supreme Court refuses to hear it, it's over.

I suppose the 11th Circuit Court of Appeals could file a writ of certorai and ask the Supreme Court for guidance, but that would be taking the weeny way out.

The judge's standing isn't relevant either. Anyway, he cited US Supreme Court rulings, and the Supreme Court rarely reviews its own rulings and almost never overturns its own rulings (although it did twice concerning slavery and race related rulings).

Obamacare clearly violates the interstate commerce clause. There's no getting around that and still maintain private "health insurance" companies.

The only option would be to create an Health Care Administration (just like the Social Security Administration) and levy a tax on everyone who would pay into an Health Care Trust Fund (just like the Social Security Trust Fund), and then the Health Care Administration would distribute "benefits" similar to way the Social Security Administration does.

Of course, everyone with half a brain can see where that will end up.

Congress will raid the Health Care Trust Fund (just like it raided the Social Security Trust Fund) and Congress will spend every single penny in the Health Care Trust Fund (just like it spent every single penny in the Social Security Trust Fund) and then Congress will very generously leave in its place a beautifully decorated IOU crafted by skilled artisans (just like it left IOUs in the Social Security Trust Fund) and then within a few short years, the Health Care Trust Fund will be insolvent (just like Social Security and the Social Security Trust Fund).

And then everyone's health care benefits will be cut, just like everyone's Social Security benefits will be cut.

You know, the Rs trying to kill nationalized health care when 71% of the population thinks that it doesn't go far enough?

And this is exactly the reason why the R's went down this road .. voting records have a knack for getting in the way when re-election time comes around.

There will be even less Dems in the Senate after 2012 as a result of this most recent Senate vote.

O.K., lets cut straight to the chase.....

If this bill is SO amazing and is going to help the millions and millions of people that do not have health care. (minus the illegals and various religons and of course the 700+ other waivers)

Why is it not implemented RIGHT NOW?

People still will not have insurance and they are still dying....right....

But hey whats another 2-3 years...
