When you claim you don't have any good example of state law that has no conflict with federal law, Arizona's law wouldn't be that, and as such can be ruled out.
Well, according to the OFFICIAL ruling, it most certainly can be. Obviously SCOTUS found no conflict.
Since the state is the entity that licenses business and enforces state law, part of that would be ensuring employees are eligible to work in the state.
In the 5-3 ruling the majority said that while federal law says the national government can’t make electronic checks of employees’ work-eligibility mandatory, the law does not bar states from doing so. And since Arizona’s law deals with business licensing — an area states are allowed to control — it does not impinge on the federal government.
So...since the FED can't make the checks, who would?
