Other legal scholars have stated that Obama does have the power based on the Supreme Court's interpretation of the 14th Amendment in Perry v. US. Since this has never been done or really tackled, no legal scholar can really claim they know whether he can or not. It's a strictly academic discussion until he actually does it.

Wrong. Jeffrey Toobin, CNN's Chief legal expert, who has done quite a bit on the Supreme Court even said that no one would likely have legal standing to challenge this in court. Congress' only remedy would be impeachment.

Let me suggest that a law like this one has to be sent back to the House with all the changes the Senate makes and then will have to be sent to a compromise committee made up of members of both houses to work out something.

The Democrats let this ride hoping they could use the method they did to pass Stimulus and Obamacare, both of which were written and passed outside the rules of both houses. This has to be done like that to get it done before Geithner's date is over run.

He doesn't need to do it since the Congress is finally started and it can get done sooner that way than the way you and so many progressive scholars believe could be done. I have read that section and read it and just can't see anything other than to cover the situation after the Civil War. Of course, you can see the arguments against him doing it in that link so thanks for asking for it.
