Young person, President Obama said about two weeks ago that his lawyers had determined that the 14th Amendment doesn't give him that power. Surely a lecturer on Constitution and his lawyers must know a little about this one. Yes, they did study it and they came out with the same ideas I have about that part of that amendment. I wonder who in the left came up with that idea.
Other legal scholars have stated that Obama does have the power based on the Supreme Court's interpretation of the 14th Amendment in Perry v. US. Since this has never been done or really tackled, no legal scholar can really claim they know whether he can or not. It's a strictly academic discussion until he actually does it.
Are you one of those people who believe like one I answered last night when he said go ahead and do it and by the time the Supreme Court ruled it would have been done and too late to do anything? This wasn't the subject but you seem to think the same ideas apply.
In case you don't know the minute he attempted this would be one minute before the Republicans took it to a federal court and he would have to wait till it worked its way through the court system. Don't put all your trust in the Supreme Court since cases don't go directly to them.

Wrong. Jeffrey Toobin, CNN's Chief legal expert, who has done quite a bit on the Supreme Court even said that no one would likely have legal standing to challenge this in court. Congress' only remedy would be impeachment.
I read that one and it didn't come from a Constitutional lawyer, either. Obama will not take a chance now that his Democratic Senate is in charge of the Full Faith and Credit of the United States and has tabled the bill the House sent to them.
Of course, Harry and his gang of thieves have set themselves some need to work tomorrow and Sunday and there is no chance that the bill can be dealt with in time to take care of Geithner's arbitrary deadline before the deadline comes and goes.
Let me suggest that a law like this one has to be sent back to the House with all the changes the Senate makes and then will have to be sent to a compromise committee made up of members of both houses to work out something.
The Democrats let this ride hoping they could use the method they did to pass Stimulus and Obamacare, both of which were written and passed outside the rules of both houses. This has to be done like that to get it done before Geithner's date is over run.

He doesn't need to do it since the Congress is finally started and it can get done sooner that way than the way you and so many progressive scholars believe could be done. I have read that section and read it and just can't see anything other than to cover the situation after the Civil War.
