At 2:00 a.m.? BS. If the guy was inside his fence at 2:00 a.m., he was up to no good, and there is no way the homeowner could know the guy wasn't trying to do them bodily harm. The lesson to be learned from this is to assume that all homeowners have guns and DON'T GO IN THE BACKYARD UNLESS INVITED.
So call the police. What's the problem with that. This kid was in the yard not the house.
Stand your ground is supposed to be when you feel you LIFE is in danger, not your property. None of you guys did anything wrong as teens, never trespassed, never took a candy bar from a store? My best friend and I once got drunk and pulled a bunch of flowers from someone's garden. Rotten, yes, and it's probably the thing I feel worst about doing as a kid, but I don't think we would have deserved a death sentence, but now I feel it could happen that way, and a bunch of people on forums would say "Well, they shouldn't have been trespassing!" I don't think burglary deserves a death sentence, either. I think this is crazy, nothing to celebrate here. IMO a sad day for all Americans. It's like the wild, wild west, and I find it frightening.
It is sad, and burglary doesn't deserve a death sentence. But if someone broke into your house or even your back yard in the middle of the night, you wouldn't fear for your life? How would you know they were unarmed and meant only to steal your stuff? As far as you know, that person could have been a murderer, rapist, or an armed robber.
In this country, you have a right to defend your property.

Maybe because the kid wasn't doing the family any bodily harm? Or even trying to get in the house? Or even trying to get in the car at that point. The family was not in any danger behind closed doors and with a gun to protect them. If the kid had started trying to break into their house, that's a different story, but he wasn't.
Well let's see. I guess someone would not have been shot for being in a yard
You're right.
Every time the cops show up in time to save a punk from a law-abiding citizen protecting his family they do a happy dance.
They know they'll have to risk their lives several more times before he gets put away for good as well as endanger the citizenry but hey...those police reports are fun to fill out!!!
Wow, where do you live. No cop here would shoot anyone for being in someone's backyard.
