That's great. That's how you choose to run your business. I'm sure the people who work for you know that, and behave accordingly. Of course, what those employees say in private, about your customers or about you, may not jibe with your policy. But it's private. Do you hide recording devices in the cabs of their trucks to enforce your policy?
For the record, I'm not defending the jokes or the language used by this group of medical professionals. Sure, it's juvenile and off color. I'm simply saying that it was not intended to be heard by, or offensive to, anyone, and that any & all damage caused was caused by the guy who secretly recorded a private conversation, not by the medical staff with a slightly bawdy sense of humor. And it's not deserving of any monetary reward.
I have a feeling the guys would not be surprised if I did hide a recording device.....
But...I won't.....I am confident we have workers with class.
If I heard a recorded conversation and the guys were being disrespectful.....yes...they would be fired.
Again....perhaps well drillers just have higher standards than doctors.....it is just disappointing.
You see I believe in freedom of speech. I believe in the right to a private conversation. While a private conversation may offend me I still believe in the right to have it.
I suspect that these medical people will be a bit more selective in their choice of humor in the future. The man in question will not change. He is a victim waiting to happen and I don't believe for a minute that the phone was left on record by accident. As I said I have had more colonoscopies than I care to remember. The instructions are straight forward. Most given before the day of the procedure. The only instructions I ever received at the hospital before the procedure was to relax and wait for the IV to put in. A brief conversation about what they will do. Sign a few forms and then lights out. Instructions follow the procedure. They too are brief.
This individual sounds like he went looking for a problem and found one. At any rate I hope he receives a grand total of nothing and is counter sued for illegally taping a private conversation.

Do you HONESTLY believe that NONE of your employees has ever made snide or disparaging remarks about you or one of your clients? Or do you get that they probably have done so, in private?

But they weren't saying it to HIM. They were talking between themselves. They were not trying to belittle or humiliate them, and there is no indication they didn't do their job. This person secretly recorded a private conversation, during which nothing illegal was said, and now wants to sue on the basis he was insulted? He COULDN'T have been insulted if he didn't secretly record them in their workplace.
UHH, hemorrhoids written on chart when the man didn't have any? Nothing is wrong here?
Does that mean I can sue anyone who has ridiculed me? In America, apparently yes and I would be willing to bet he actually WINS something... only in America!
I would also sue................................ THE PATIENT!
1. Sue the providers? What damage have you suffered as the patient? What income have you lost? Did you incur any costs by the conversation?
2. I WOULD SUE if I was one of the providers. Why?
a. illegal recording of conversations
b. public presentation of those conversations
c. lost revenue as a result of the disclosure
I think that the PROVIDERS would have a good suit against the PATIENT. If I was the provider, would I settle. No- however, I don't think I would be in that situation in the first place. I keep my mouth shut about patients; my wife has said more than once, "gee................ you saw one of my friends the other day. Why didn't you tell me"?
If you are a provider.................... DON'T TALK ABOUT PATIENTS.
Thank you! I'm sure this is what we all hope our medical provider is doing. It's bad enough to run into the gynecologist in the supermarket, last thing we want to know is he and his buddies discussed, well you know!
The guy or us would have never known this goes on if the doctor and staff were doing their job and not talking about others. Instead he turns on a recording to hear negative things about his own body and things put on his chart he didn't even have!
Was the doctor arranging more work this way?

Didn't sound like he smuggled anything, he forgot to turn it off. So it's okay for people to be rude, but another for someone going into a procedure to forget.......... UGH
I understand people are rude, doctors are to be professional not talking like construction workers or bikers in a bar.
Putting something down on the man's chart when he didn't have hemorrhoids, should be grounds for something.
