Tameika Guest, who is suing the Charleston County School District on behalf of her 12-year-old son, claims the child was intimidated and prevented from learning by the behavior of the other black students at Zucker Middle School. The lawsuit is seeking a jury trial for unspecified compensatory damages due to a violation of the student's civil rights.

"He shouldn't have to go to a school where he encounters that level of obscenities, racial slurs and the N-word," Kobrovsky said. "That's certainly detrimental to learning for any student."
Well I am not a lawyer but I believe that parents can sue school district for Failure to Supervise.A school obviously has a semi-custodial relationship with its students, a school can be liable for the acts of a student. Generally, a school must act negligently in supervising a student who then commits a crime or injures another person to be liable.

I would sue the students parents or legal guardians instead. (I being the key word here as I can only speak for myself). I don't believe school district is nearly as responsible as these students' parents or legal guardians.

Because they have the freedom of speech to say what they want, with very narrow restrictions.

Makes sense, thanks!

I have never actually heard a person say that in real life, only in the movies or " someone told me one time that".

Maybe. Or maybe, as rggr pointed out, they are looking for a broadly applicable ruling that will have some serious law enforcement teeth.

Edited to add - Or both. There is no law that requires a person to have only a single motive!

I don't doubt your experience at all. Matter of fact, I do believe some blacks dislike Asians or Mexicans or white.

I live in orange county, California. My brother's best friend is an AA guy and he has been jokingly called Uncle Tom by some AA friends of his. He has absolutely no problems with Asians or white. (We are German/Irish/Japanese/Hawaiian mixed) Matter of fact, I don't believe he has problem with anybody.

In downtown LA however, there are a lot of blacks don't like Koreans because Koreans are mostly business owners who open businesses in black neighborhood.

So it all depends on the area you live I guess.

Well we are practically neighbors. San Clemente I feel that I live in my own little neck of the woods. Do not experience much here, infact I know many different races and they do all get along. But I am honest and mostly all white live here.

But I also lived in other Counties, where the demographics were different, and still my kids and their friends who were different races all got along. Infact the Asians and the blacks Mexicans, all got along, although this was many moons ago. Depends on what kind of area you live in it really does.

Sometimes I think that things are changing and not for the better, although this depends on where you live and in what city. Tell you the truth the only problems my then young boys had, were with bratty stuck up white kids. Which was many moons ago.

Pretty much my experience as well. I was born in Oklahoma city but I grew up in Germany and had spent years in Japan and England. I can't say that I have experienced much racism growing up but then again I had always lived in pretty conservative neighborhood. (for lack of a better description) I love people from all races. I don't judge anybody based on their colors. Heck, I don't even know how to define myself racially because I myself am mixed.

In LA county, I've heard different stories. Racial tension is definitely there in SOME areas.

Most blacks in the downtown area don't have issues with Korean Americans. Most of the hostility towards Koreans Americans is toward shop owners that disrespect the black community...
