State vs. Federal Law: Who Really Holds the Trump Card? | HuffPost

Quote:
Wrong. The law that applies to situations where state and federal laws disagree is called the supremacy clause, which is part of article VI of the Constitution. The supremacy clause contains what’s known as the doctrine of pre-emption, which says that the federal government wins in the case of conflicting legislation. Basically, if a federal and state law contradict, then when you’re in the state you can follow the state law, but the feds can decide to stop you. When there is a conflict between a state law and federal law, it is the federal law that prevails. For example, if a federal regulation prohibits the use of medical marijuana, but a state regulation allows it, the federal law prevails.

I'm moving out when I retire in 4 years and it can't come soon enough. Regardless, CA has been a sanctuary state for several years already. It just wasn't on the books yet as official.

Let's not also forget CA leads the country in poverty with one out of 5 living at or below the poverty level. For all it's bluster, it has more people on welfare per percentage of it's population than any red state in middle America.

Here's a question for you however. Do you think "amnesty for illegals" is a winning platform for Democrats?

(I encourage the Democrat party to keep pushing it.)
Well..I'm not a dem...but no..I don't think so..they'd sew up the Latino vote...at the cost of all the law and order types.

I'm against amnesty, in general..I do think a road for the DACA folks is OK...but most illegals..need to leave. I'm just not willing to throw States Rights out with the illegals. The Feds should just forget using the states as their cats-paws..and shoulder the burden..and the political consequences of enforcing the law.

To be fair: "Hispanics" ain't reliable Dem voters, their kind are more like "Italians", not American Blacks who have the rep of almost always going for Hillary's party.

With more and more Latinos "marrying out"; many times their kids ID as "anglo white", especially if they don't speak Spanish AND the birthrate for at least US citizen Hispanics IS dropping like a rock.

Well when Trump starts clamping down harder on illegals they will all flock to California.
If DACA goes belly up there's another million+ that will flock to California.

I wonder if the VICTIMS consider those crimes to be "minor offenses" also many criminals commit minor crimes and then go on to the bigger crimes or murder .
The feds can always get whoever they want with a valid warrant signed by a judge, no LE agency in California will refuse to honor a warrant, or they can wait outside the jail for the individual to be released.

I would think they would know better. Then again we are talking about deranged Democrats headed by governor Moonbeam.
Unless, you are a native american, then you are an immigrant. And immigrants are why our country is so great today.
