They can pretty much as far as EEOC and courts are concerned. It's when a white person particularly Christian or male tries it, then it's considered violating the civil rights act.

I'd also add that if a black man only wants to sell his products to white people that too is his right. The collectivist grouping doesn't necessarily have to line up.
Hell, there's no reason to even give a reason. I make a chair and put it in my storefront window. A person comes in and offers me $500 for it. For whatever reason I don't want to sell it to this person. A minute later another person comes in and offers me $1 for it. For whatever reason I agree to the sale.

This all just another example of the court declaring a law means whatever a court says it means even when the law has a clear and long standing understanding of its meaning. The protected class of sex clearly meant no discriminating based on male or female but not sexual preference, orientation or sexual behavior.
Just like protected class of race meant no discriminating based on just race and did not mean equal outcome for all races.
Just like the commerce clause clearly didn't give the government the right to tell private businesses and property owners they could not discriminate in the first place.
The judges and judiciary are way out of line and something needs to be done. With activist judges revising, reinterpreting and rewriting laws, there's no point in having a constitution or a legislator.

Better yet delete "in the past" since "was" is past tense.
The word order correction was due to the fact you indicated your sexual orientation was different in the past.
Actually, I had to make two corrections.
I changed "has been" to "was".
Adding has been changes a verb to the present perfect continuous.
If you said: "My hair has been white since I turned 50." It means it is still white today.
The verb here is "be". It is understood.
"My hair is white and has been white" would be redundant.
Your sentence as written means you are still being actively fired now because of a sexual orientation you had in the past.
And now you have:
As somebody who was fired because of my sexual orientation, this is great news.
The judges and judiciary are way out of line and something needs to be done.
