Actually the 14th Amendment doesn't have to be repealed it just needs to be re-visited by the Supreme Court of what it's true intent was at the time by the wording of it.

I bet the plane never turned around. I am willing to bet it continued to its destination. Especially if over international airspace a judges orders are not enforceable. And the captain of the flight has final authority over the flight, not a judge.
