I think you, perhaps intentionally, confuse who was the perpetrator and who was the victim.
Says you. Prosecutors don't use terms like 'clearly'. You don't show an understanding of the parameters of self-defense.
Self defense laws vary by state. In Missouri, you may defend yourself your family, your property, your neighbor and their property with deadly force if YOU deem it necessary.
The bodega owner was approached by a man yelling at him. We know that later he stabbed the man to death.
Unless there is more involved, you don't get to stab someone yelling at you. Its not self-defense, which involves proportionality.
I guess the video you saw edited out the the attacker going behind the counter, shoving the bodega man, refusing to let him leave, and grabbing him behind the neck.

The victim was the guy who was violated when a perpetrator came into the space where he was not allowed. I don’t care whether a prosecutor uses the word “clearly†or not. I am not in that role here. And having worked in the legal system for over 30 years, I can attest that, yes, some do utter that word.
You clearly don’t understand the parameters of NY self-defense protocol. The victim, who was being intimidated, followed NY state law re self-defense by trying to leave through the exit whereupon he was followed and assaulted.
You may have given talks on self-defense, so what. In speaking of this specific matter, your words show misinformation and misinterpretation.
The Lady who stabbed the Bodega-worker is not being charged, and she started the whole thing, and stabbed the poor man..........how does that spell fair?!?!?!!?!?

Yeah. Also left out the women saying she's going to go get her man to attack him....goes and gets man and he proceeds to go behind the counter....
They had a decent article on this on CNN this morning where they talked with a former prosecutor (or def atty) and they basically said that the DA can bring that charge but no jury is going to convict him.
Surprised posters haven't claimed the victim was 13 and the 61 year old man chased him down the street and stabbed him.
Proportionality, for one. If someone is throwing marshmallows at you, a person is not privileged to shoot the thrower. Immediacy is another. You can't wait to use deadly force.

None of what you mentioned is deadly force. So why use deadly force to defend against such?
Says you, bud. Point out any misinformation or misinterpretation.
You are uninformed/ignorant/misinformed about self-defense law in NY state. I have already explained specifics about that. Not doing it again.
