I took my property off the market for personal reasons, Then two weeks later my circumstances changed again.
If I want to rent/sell the property privately to a freind/ collegue that approached me after I withdrew it from sale, and that person did not come into the house while it was on the market, where do I stand legally. I have read the contract over and over and it still is not clear enough to me. However the listing period is still current with the realtor who was marketing the property originally.
It will depend on the specific terms in your listing agreement. Ask your Realtor for clarification, or their managing broker. If you want a fully independent opinion, then review with a lawyer.
It is still listed with the brokerage. You may as well inform your agent and get the deal done.
Yeah, I wasn't sure about that from the OP's post. She said it was taken off market, but that the listing period was still current. If it's still current, then likely she owes a commission if her friend buys. If it was actually canceled, then depends on terms of the hold over period.
I think CA has withdrawn and terminated status like we do here. Withdrawn means the listing contract is still in effect the property is just not being marketed. Terminated means the contract is terminated and done. I think it depends on whether or not your house was withdrawn or terminated.
Yeah.. down here we have withdrawn and then withdrawn unconditionally. The first has a protection period...they can not list with anyone else until the end of the listing nor can they sell to anyone without owing a commission. The latter means it's over and done with, the seller can do what ever they wish to do.
