What happens to an interested buyer after a listing expires? If an agent showed us a property, is she still entitled to a commission if the seller were to sell it to us after the listing expires?

We made an offer, got a counter, countered that offer, got the identical counter again (odd?) and now it seems the listing has expired. Can we call the owner (FSBO sign on lawn) and if he did sell to us, would the agent still get a commission? Should we continue to go through her or call the seller directly?

Default expired listing, buyer still interested

What happens to an interested buyer after a listing expires? If an agent showed us a property, is she still entitled to a commission if the seller were to sell it to us after the listing expires?

When did you make the initial offer, and what kind of time has elapsed since then? It's possible that if it were near the end of the listing period, the seller stalled negotiations until the listing expired to avoid paying any commissions at all. Are you still working with your buyer's agent? Are the selling and buyer's agent one and the same? It is very possible, though the agents involved are still due a commission, depending on the verbage of the listing agreement.

Depends.

In general listing contracts have a clause that extends their reach forward for some months in terms of buyers who looked at the property while listed.

If you have no contract with your agent you are likely not bound unless you feel ethically so. Note that the sellers agent has a right to and will collect both commission if you are unrepresented.

The web woven is complex after the listing expires.

The listing brokerage would probably be owed a commission, until relisted with another brokerage.

The agent that should you the property - it would depend on whether you have an agreement in place for brokerage services.

If you signed a buyers agency, which I assume you did, since you made an offer on this home, you might want to read that. There are clauses in it that say how much commission you will pay, should the seller not pay. This is written in a blank space on the buyers agency form, and usually it is left blank, meaning you wouldn't owe them anything.

As for the seller, in Missouri at least, the seller's agent has to give the seller at the end of the listing period a written list of people that saw the home (name of their realtor will suffice). Only then will they be due commission if one of the people purchase the home within a certain period of time. If the home is relisted, even within that period of time, then they aren't owed anything. Most agents do not give the sellers a list unless they have someone who seems very interested when the listing expires.

In our listing agreements we have a clause for 30 or 60 days, whichever we put in, that protects us if someone we showed the house to during the listing puts in an offer within that time after expiration, so we still receive the commission.
