That's what you are proving by testifying that you contacted the employer and left messages, and the messages weren't returned. You TRIED to go back to work, but you weren't allowed to. Therefore, there was NO job for you anymore.

Just be careful with the witness because there is the potential for a lot of hearsay that will dilute the stuff that does count.

The witness can say that you called him

The witness can say what he said to someone, but not what the other person said to him

The witness can say that after he said something to someone he saw them do something

Just got off the phone from.my hearing , she asked me if i physically tryied to.go to work i answered "no" i told her my boss told me on the phone " get well and keep me posted let ne.know when you are able to cone back and ill let u know if i still need you"

my employer did not show .

She told me " do you still want me to call your witness i belive wgat are you are saying and your employer is not here to say otherwise"

i said yes , witness did not answer .

Hope this goes well , im still nervous for my decision .

Just wait for the decision. You had the judge saying, "i belive wgat are you are saying," and the employer didn't show. Things don't get much better than that.

I am curious as to why your witness didn't answer the phone. You communicated with this person before hand. I hope this wasn't a good friend of yours because that's just not what a real friend does.
