Diesel Volkswagens and Audis have hidden software that detects annual state emissions tests, turns on full emissions control systems during the tests, and turns them off again when the test is over -so they can pollute and get better gas mileage the rest of the year. This willful violation of US law could cost VW $38,000 in fines per vehicle (x 500,000 vehicles = $18 billion), plus recall costs.
The scam gives VW a competitive advantage (they could claim better gas mileage) over US manufacturers. If consumers submit to the recall they will wind up with worse gas mileage and possibly emissions test failures.
"The cars, all built in the last seven years, include a device programmed to detect when they are undergoing official emissions testing, the EPA said, adding that the cars only turn on full emissions control systems during that testing. The controls are turned off during normal driving situations."
Over U.S. manufacturers? Until recently there were none offering a diesel in a car.
The story also makes no sense. The MPG ratings are achieved during testing.
Fuel economy and emissions are two separate tests.
"Fuel economy is measured under controlled conditions in a laboratory using a standardized test procedure specified by federal law. Manufacturers test their own vehicles—usually pre-production prototypes—and report the results to EPA. EPA reviews the results and confirms about 10%–15% of them through their own tests"

Nah, that's not the reason. (and there are almost no US manufactured vehicles with diesel engines anyway)
The reason is that it allowed them to forgo having to use Urea (pee) Injection to meet US emissions. Car owners would not have to maintain a tank of this stuff that is found on other diesel engines.
I think the part some are missing is that the car has a "normal" setting that gives it the higher gas mileage etc. but that would not pass the emissions test.
So, when it's being tested it switches over to "pass the test" mode.
This is going to be one ginormous penalty.
Then there is also going to be the civil class action suit for all the people no longer getting the gas mileage they thought once the recall changes their software.

Can't trust volkswagen but we can trust Iran to take their own test samples.
CAFE standard are essentially the same legal scam. they average a company's different models gas mileage. Truck with 10 mpg and a electric/gas car with 50 mpg get averaged.
