I am going to put in an above ground pool(I live within an HOA) Does anyone know how far from the property line you have to be? I have common area behind me, neighbors on 1 side and road on another. I've heard anywhere between 4-6ft. 5ft getting the most votes . I'm in Berkeley Co. if that matters.

I never received the HOA covenants/restrictions only was able to look it it before closing and can't remember. I have not been able to get in touch with anyone from the county(not to my surprise)

Before you build anything, STOP!!!!!!!!!!


Get a copy of your CCR's. They may preclude you putting in a pool.

If you called the County/Town Zoning office today they were likely closed due to the holiday.

Your CCR's will likely override any County/Town ordinances if they're stricter.

Agreed, 100%.

It's awfully expensive to dig up a pool and move it five feet farther from the property line.

Plus, the HOA/zoning regs very likely address issues such as fencing, locks, etc. that can add quite a bit to the cost.

I don't know about HOA covenants, but my property has deed restrictions, and they are filed with the county, along with the deed, so you should be able to get those from the Register of Deeds in your county.

Berkeley County subdivision regulations of 2009 stipulate a 10' setback to the front and sides, and 20' from the rear. You HOA may have stricter requirements: http://www.berkeleycountycomm.org/do.../subdv2009.pdf

I'm not sure that information is pertaining to homeowners, it sounds more like land developers(maybe I'm wrong?) but if I had to keep structures 10' on each side and 20' from the rear I wouldn't have hardly any yard left....and our HOA allows above ground pools and with most lots only being 1/4 ac. I can't see how that could apply??

Setback limits are for homeowners, too. I doubt an above ground pool falls into this strict of a category though, since it's not 'permanent', but it wouldn't hurt to check. Better get a copy of your HOA covenants, too, like others have suggested.

As for deciding what zoning regulation applies to whom, if you haven't seen them, how can you decide the zoning regs don't apply to you?

I don't get it, OP. You said your saw your HOA covenants but didn't insist upon a hard copy before you closed on your property. What were you thinking? And now that you're planning a big investment (the ground needs to be prepared as well as purchasing the pool), you still haven't made it a priority to find out if it's even permitted? If you can't get a response to a phone call, GO in person to the recorder of deeds and get a copy of the zoning ordinance as well as a copy of your HOA covenants. This is part of being a grown-up.


I guess some people have money to throw away.

You also need Building permits & Pool Must be inclosed by fence! There are Lots of rules for putting up a pool .....
