  • Hair Restraints (46.152)
    (a) General requirement. Employees shall wear hair restraints such as hats, hair coverings or nets, beard restraints and clothing that covers body hair, that are effectively designed and worn to keep their hair from contacting exposed food
  • Preventing Contamination from Food Contact with Equipment & Utensils (46.301)
    Food shall only contact surfaces of equipment and utensils that are cleaned as specified in § § 46.711—46.719 (relating to cleaning of equipment and utensils) and sanitized as specified in § 46.731 (relating to sanitization: requirement, frequency and methods). - Employees were observed using wiping cloths from the dirty dish cart to wipe down tables. - Food (potatoes, tomatoes,lettuce) were observed being washed in the hand and garbage grinder sink. Management was instructed to initiate immediate corrective action.
  • Cold Holding Potentially Hazardous Foods (46.385(a)(2)-(a)(5))
    (a) General. Except during preparation, cooking or cooling, or when time is used as the public health control as specified in subsection (c), potentially hazardous food shall be maintained at one of the following temperatures, as applicable: (2) At 5°C (41°F) or less except as specified in paragraphs (3)—(5), or § 46.584(b) (relating to vending machines). At time of inspection the ambient air temperature of the 1st flr. walk-in ranged from 45- 49.6 F. Potentially hazardous foods had good internal temperatures. Management was instructed to immediately move all potentially hazardous foods to a cooler that meets appropriate temperature. Repaur defective walk-in box immediately.
  • Accuracy of Temperature Measuring Devices for Food (46.561)
    (a) Accuracy range for Celsius-scaled or Celsius/Fahrenheit-scaled devices. Food temperature measuring devices that are scaled only in Celsius or dually scaled in Celsius and Fahrenheit shall be accurate to ±1°C in the intended range of use. (b) Accuracy for Fahrenheit-scaled devices. Food temperature measuring devices that are scaled only in Fahrenheit shall be accurate to ±2°F in the intended range of use. None of the thermometers provided were accurate, thermometers in all refrigeration units reported temperatures 5-10 degrees lower than the actual temperature. Management is instructed to initiate immediate corrective action.
  • Maintenance & Operation of Manual Warewashing Equipment (46.676(a)-(c))
    (a) Warewashing sinks: use limitation. A warewashing sink may not be used for handwashing. Warewashing sinks may not be used for food preparation. At time of inspection male employee was observed washing his hands in the rinse compartment of 3-basin sink. Management was instructed to initiate immediate corrective action.
  • Objective of Cleaning Grease & Soil Accumulations & Nonfood Contact Surfaces (46.711(b)(c))
    (c) Nonfood-contact surfaces. Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue and other debris. - Black hose in walk-in box needs cleaning due to mold observed at time of inspection. Management is instructed to initiate immediate corrective action.
  • Storing Clean Items (46.774)
    At time of inspection knives were being stored between the cold holding unit and the prep table (along the cookstation).
  • Backflow Prevention Device when Required, Backflow Prevention Device on Carbonator (46.823(d)(e))
    (d) Backflow prevention device: when required. A plumbing system shall be installed to preclude backflow of a solid, liquid or gas contaminant into the water supply system at each point of use at the food facility, including on a hose bib if a hose is attached, or on a hose bib if a hose is not attached but can be attached, by an approved backflow prevention device as specified in § 46.822(d) (relating to design, construction and installation of plumbing systems). Provide backflow preventon device at 3-basin sink, grinder sink, and future food prep sink (when installed).
  • Retention, Drainage & Delivery of Sewage, Other Liquid Waste & Rainwater (46.862(b)-(f))
    (b) Backflow prevention. (1) Except as specified in paragraphs (2) and (3), a direct connection may not exist between the sewage system and a drain originating from equipment in which food, portable equipment or utensils are placed. A food preparation sink was not provided at the time of inspection. Food preparation shall be conducted in an approved preparation sink. Management is instructed to initiate immediate corrective action.
  • Covered Waste Receptacle in Women's Toilet Room (46.882(b))
    (b) Toilet room receptacle for sanitary napkins. A toilet room used by females shall be provided with a covered receptacle for sanitary napkins. Provide a separate covered waste receptacle inside of women's restroom for the disposal of sanitary napkins. Management is instructed to initiate immediate corrective action.
  • Cleaning Ventilation Systems (46.981(d))
    - Replace missing filter under exhaust hood - Pipes under exhaust hood need cleaning due to dust accumulation observed on pipes at time of inspection. - Grease basin missing under exhaust hood
  • Controlling Pests, Removing Dead or Trapped Birds, Insects, Rodents and Pests (46.981(k)(l))
    (k) Controlling pests. The presence of insects, rodents and other pests shall be controlled to minimize their presence on the premises by all of the following: (1) Routinely inspecting incoming shipments of food and supplies. (2) Routinely inspecting the premises for evidence of pests. (3) Using methods, if pests are found, such as trapping devices or other means of pest control as specified in § 46.1026(b) and (c) (relating to pesticides). (4) Eliminating harborage conditions. At time of inspection fresh mice droppings were observed on the stairs in the kitchen (leading to the basement). Eliminate mice infestation immediately. NOTE: Owner provided receipts of vermin control services offered by Ecolab, most recent receipt provided was dated for 12/18/2010. Management was instructed to initiate corrective action.
