I guess it tricky right? What is motivated by hate. I mean the most recent police shooting all over the news is about a black suspect who wrestled a police officer down and grabbed their taser before being shot. and of course the headlines read that a white cop shot a black man. Until this narrative switches to cop shot man who wrestled taser from his hands, then maybe we can give the befit of the doubt here?

The owner asked them to leave when they apparently started shouting “Black Lives Matter” and demanding the staff also say it, according to the police report.

After they were escorted out, all the while allegedly screaming a variety of “racial slurs” and spitting at employees and the 15 or so patrons, they allegedly threw a 20-ounce Sprite bottle at the glass door, along with other things, breaking it. The police estimate the damage at more than $2,000.

Another little tid bit from this wonderful story of kids just being kids

Can’t wait for those sweet little angels to hop on red line and go on a field trip to Harvard or Davis Square, or perhaps the green line and head over Coolidge Corner or some other bastion of diversity, tolerance, inclusion, proper pronouns and at least 10 BLM signs per square foot. JP would be an excellent choice as well, all those artisanal mustache wax shops need to express their solidarity!

At the federal level, hate crime laws include crimes committed on the basis of the victim's perceived or actual race, color, religion, national origin, sexual orientation, gender, gender identity, or disability.

So basically a hate crime could be any attack. It's hard to rule anything out as far as i can see.

To be honest who cares if it was a hate crime? Someone was attacked for no reason. That is bad.

This is really bad because she*t like this happens all the time and gets swept under the rug, yet we'd have 24/7 media outrage and cities on fire had the roles been reversed.

Right I dont agree with the sweeping under the rug when it's black people beating up a white person but when the roles are reversed there's an outrage.

I can't think of situation that happened recently where a group of white people beat up a black person. Seems like the narrative has been white cop shoots black person.

Shouting the slurs while in commission of the crime is what would establish it as a hate crime. That said, everything has to pass the legal (and perhaps political) smell test of the prosecutors. It all depends on how things went down and what they think can prove.

Honestly, it seems like it would be very difficult to prove whether an attack was "motivated" by hate or not. I do sense that the burden of proof increases if the victim is white or Christian vs. "anything else", just based on past incidents.

Well if someone is bashing you over the head with a fist or weapon and shouting "you effing _______," I think that's pretty good evidence on its face. Don't you?
