Yes, but the difference in the way the patent works is entirely attributable to the fact that plants and animals can reproduce. I don't see it as an odious restriction, because after all, the patent is only good for 20 years. Then the restrictions and the need for licenses lifts.
As we have seen in the past, either the government or companies will come up with ways to either extend patents or have something new approved that covers what the old patent did...

It is the God Complex. We don't like the thought that we aren't the Supreme Being. I discuss research with my PhD niece about misuse of discoveries. One thing, maybe the only, we agree on is that any research will be misused. If you aren't going to shut down all labs, you have to somehow factor that realism into what research is positive and what is pure and simple greed.
