You are correct in that the National Highway Traffic Safety Administration department has classified NEV's. And there is a definite distinction made between a golf cart and NEV's. So I assume it's up to the individual states to look up the NHTSA classifications, safety requirements/regulations, speed limit & road permissions and create additional regulations specific to their state if said state chooses to permit NEV's on public roads? If people want NEV's to be legal in their state, it sounds like they will have to contact their legislators and work with them to write legislation.
The method that seems to have the best chance is to get the state to legalize the use of NEVs as low speed vehicles under motor vehicle regulations but not set specific laws that impact municipalities. Because of the continued confusion and the misapplication by golf cart users, localities are still a bit resistance to being forced to accept them. So, getting the state to simple set standards and generic regulations, that leaves the actual "where you can actually use it" to the individual municipalities to decide.
My hesitation in using NEVs is mainly safety... I like the idea and think that areas with high NEV use need to be low speed.
There is family that rides around in NEV in my current neighborhood. I hope they never get hit by a car. (really, I hope no one gets into an accident...) There is a high chance of serious injury to the occupants. Not that it would be pretty in a passenger car, but I keep thinking of all the landscaping trucks and trailers and how some of the landscapers drive them like they stole them around here.
