When I bought my condo 18yrs ago, I remember I was supposed to get a copy of the by-laws before the closing, if I recall correctly. I did not, but knew other people that lived in the complex. I supposed I could have refused to close since they hadn't honored that. I had a friend who bought a townhouse that the realtor assured her could have pets. After she moved in with her dog, she was told they weren't allowed, fortunately for her the let her keep it. (There was only 6 units in the whole place.
Having been through this before, I don't think I'd buy in another HOA without being able to at least review the rules. Knew someone who bought into an adult community, no motorcycles were allowed. Visitors with motorcycles had to park at the clubhouse. I don't think I'd buy in there, as I have two motorcycles myself.
Big diff is that we're not a condo assoc. All homes are single family and we own the land that the house sits on.
You are still entitled to the HOA rules prior to closing. Just because they were not given to you does not mean you couldn't get them.
My comment was not in regard to getting the By Laws, but was in reference to the law for Freedom to Fly the American Flag Act 2005. They can stop you if it's a condo because you don't own the building. We own the home and the property outright.

I'd be willing to bet that either you're a gov't/union employee or somehow have a relation to housing and HOA's.
