Gov't drops defense of anti-gay marriage law - Yahoo! News (http://news.yahoo.com/s/ap/20110223/ap_on_re_us/us_gay_marriage - broken link)
Looks like our President has finally grown a pair.
Obama is helping to reverse the damage that gutless President Clintoon did in 1996.
otoh, if Clinton had not signed it, perhaps the congress would have pushed for a Constit Amendment to bar marriage equality, which would have been harder to overturn at a later time.
The idea of marriage equality was a very unpopular idea at the time, and most likely would have passed, even with the huge hurdles that an amendment to the Const entails.
'Bout time too. They will be asking judges nationwide in all federal cases to strike down the DOMA defense of marriage act as discriminatory and illegal.
A Large Welcome to the United States to all the religious crazies who have ruled this issue for to long. Have a big cup from the Obama Administrations new pot of coffee~~

Equal Rights means Equal Rights.
No matter what you're opinion is on this issue, Obama is overstepping his legal boundaries. He is acting like he is a King, He has no right to order the DOJ to not defend a law that was passed congressionally. He should be following the legal process. You know "checks and balances."
But, just like the Dems in Wisconsin, he apparently doesn't believe in our system of government anymore.
I am t r u l y amazed that people defend this on any grounds. It is discrimination even if congress passed the law. The principle of equal rights is bigger than congress bigger than any person., if it goes against the principle of equality it is WRONG...as it defines what the United States is.

The DOJ is part of the executive branch. He is our chief executive.
In what alternate universe does he not have the right to order his own organization what to do?

He does. Federal law requires the Justice Dept. to notify congress when it decides not to defend a law. There have been a little over 13 such notifications in the past 6 years.
I don't see conservatives objecting when Bush did this. In fact, the Bush administration failed to even follow the notification law. The Bush administration time after time refused to enforce environmental, immigration, mining and labor laws. It refused to defend them in court. In one timber case, the Bush administration took action to delay enforcement of the law. Private groups had to sue to get the law enforced.
