The charge has already been made in the court of public opinion by the copyright holder. A simply apology on Fox's part is probably all that would be needed, though I would love to see REM sue just to make a point about copyright.
As an amateur lawyer in the court of public opinion, I think Fox shouldn't worry about it and just not play more of their songs just to be safe.

Wow, if I knew ahead of time that all I would get is an "apology-on-the-wrist" and not jail time and mountains of fines, then you bet I'd be violating copyright...left and right. As it stands, I stand by my earlier post to go with royalty-free works, as even those doing covers of popular songs need to have permission from the original artist, as I understand it.
Virtually every time the right hijacks songs from artists, they are immediately slammed by the artist and served with cease and desist papers, and at the DNC is the latest case.

It's interesting that the law now makes colleges and universities legally responsible for students who pirate music, movies, etc. Where I am at, the University monitors how students use the Internet, meaning how much data they are downloading, and charges students in student court if they infringing on the copyright of others.

Yes, definitely, but given the Copyright Extension Act, we would only be hearing REALLY OLD tunes at the RNC.

Undoubtedly, he is paying royalties to do so through ASCAP, BMI, or SESAC licenses.
