There is legal history involving this. If the position in the religious school includes religious duties (priest, pastor, Sunday school instructor), it's exempt from the law. If the position in the religious school does not include religious duties (janitor, PE teacher), it is not.

Right or wrong? The school was wrong. Ms. Hale did not do anything illegal or inappropriate. She was just listed as a mourner in an obituary, along with her partner.
Hope she sues them.
She knew what the schools policy was and she violated that policy.
How is a PE teacher preaching their beliefs, teaching their faith, or carrying out their mission?
I don't recall dodgeball or calisthenics mentioned in the bible.
As I noted, it will not be difficult for a Catholic school to argue that ministering to students includes their physical health.
It seems very clear to me. Nowhere in the US can you be fired (or not hired) because of your race, sex, national origin, or religion, and in many parts of the US - including where this school is located - your sexual orientation.
Note that, with the exception of religion, these are innate, biological characteristics (religion being a lifestyle choice).
Nazism is neither a race, sex, national origin, religion, or sexual orientation.
A religious school usually has a different contract where you state that you live according to the teachings of the Bible (or something along those lines).

There was a recent case in which a office assistant that doubled as a sunday school teacher was labled as a "teacher" and as such could not sue the school for what ever damage[I dont remember all the priticulars of the case] she was seeking. Being classified as a teacher made her ineligible to sue for damamges.
