Some states do allow lethal force in defense of property (TX comes to mind), unsure if WV is one of them.

Irregardless since the shed kind of wasn't his property either way a crime was committed.

IIRC in MN a guy (white) executed two (white) teenagers that broke into his home; he faced life in prison.

Know your morals and your laws if you're going to use a gun.

If he lives in a state that allows lethal force in defense of property, then it shouldn't be a problem. He could just argue that he made a mistake. Acting what he believed to be lawfully, against people who he believed to be acting unlawfully, is a strong case to argue against. Making an honest mistake isn't a crime in itself.

Otoh, he could just be a trigger happy nutter.

I wouldn't put it past them. Fox news scares me with all their race incidents. Before I was independent, instead of conservative I would watch it with my roommate. The stuff they say is really wrong.
