IIRC a gay group in New York City *Did* sue and lost, all the way up to the SCOTUS *I Think*, will have to look it up.

Basically it came down to the same issue with the Boy Scouts; the USC guarantees freedom of association for private groups. The Saint Patrick's Day parade up Fifth Avenue *may* seem like a public event, but it isn't, rather one sponsored by a private group. Of NYC or any other city where this battle is being waged tried to put pressure on the "Irish" say by denying them a permit they would have been hauled into court and loose. Thus for years all the finger waging, hand wringing, begging and out right threats which thus far did nothing to move that goal post.

The parade is to honor Irish heritage. Not a platform to tell the world that you prefer to sleep with the same sex.

Gays were not told to stay out. The pushing of the gay agenda with the rainbow banners, etc is what was not welcomed at the parade.
