I want to sue the restaurant because a server didn't want to serve me.... so a different server did!!
Firstly that is a private business, refusal of service there should be up to the owner and IMO that can be for any reason. You can go down the street and find a restaurant that will accommodate your needs.
Secondly Davis was refusing to allow anyone in the office to issue them and there is no where else to go.

You are barking up the wrong tree, if this was a baker I would completely agree with you. This is not a baker who owns his/her own business. It's a public official who has been tasked with issuing marriage licenses, the law say she cannot discriminate against gay couples. Case closed, issue the license. Her personal beliefs are irrelevant to the job she has been tasked with.
