I blame him, he clearly was aware of the situation where people earning $15 an hour were paying more income tax than he was and if he had any integrity he would have had the Republican Senate close those loopholes in the tax bill, but instead he remained silent because he clearly didn't want to lose them.

That is something the left just loves. Preserving the land and limiting future development. Get a tax deduction.
You have totally misstated the issue that is being audited. Go back and reread.
In any case, if the IRS thought they were dealing with tax fraud they would have charged him with tax fraud. They wouldn't be negotiating with him for ten years.
Likewise, if they are just arguing with him over a tax deduction not involving fraud they would have already disallowed the deduction and sent him a bill. Not all disputes with IRS over what can or cannot be deducted turn into a case of tax fraud.
The reality is they don't like to go to court unless they think they have a sure win.
It is not uncommon for tax laws to have ambiguities in them that can allow an accountant to use them in a way the IRS did not anticipate or intend them to be used.
