We are signatories of the 1967 Refugee Protocols, which does carry certain obligations with regard to the treatment of refugees. In particular, it includes articles 2 to 34 inclusive of the 1951 United Nations Convention Relating to the Status of Refugees.
These provisions look like they limit the types of special restrictions you can place on refugees. If we expect other states to accept refugees, we should try to follow the same agreement. The other option is to withdraw altogether, which would likely make us look evil.
The problem is that most of these people at the southern border are not legitimate refugees. They just want to get in to the U.S. without jumping through the legal hoops required when applying for residency. Democrats want them here for various political and economic reasons.
EO's ? all Biden is doing is setting policy for the executive branch during his tenure as President, they're not laws. He'll run out of this stuff soon enough. Big issues, like climate change, immigration, infrastructure, et., etc., require Congressional approval 60 votes and Mitch's approval. Filibuster is out. Dems caved on that (filibuster) when they agreed to 50/50 Senate rules. They aren't a part of the budget reconciliation measure. Mitch will give him the same level of Unity that Biden has shown him so far.
