According to the report he may very well have made a mistake in shooting her (no kidding!) but, since he actually saw her in good faith as a lethal threat to the politicians he believed were just beyond the barricade, his shooting is justified.

So in other words he can be negligent or reckless in using deadly force because he is special and Ashli is not.

Since they do not release the information, as to who shot Ashley Babbit, they leave the door open for speculation.
