So you agree that intentionally misleading a person about your sex, to the point of sexual contact, should be a crime under law?

It depends. If someone’s sex at birth is male, yet they’ve transitioned into a woman and have been that gender legally years, for example - then no, I don’t think it should be a crime. What a person was in the past is not necessarily relevant at this point. If all their characteristics are female, they take female hormones, they have gender reassignment surgery and their identity in all legal forms concur, then no it’s not a crime under the law. If they’ve satisfied the law they’re legally female, then that would be the end of that in a legal sense. You can’t allow people to legally transition to a different gender and then prosecute them for not revealing what is, essentially, a dead identity. They aren’t required to disclose such under any other circumstances.
Whether someone has a moral obligation to disclose is a different matter. If someone is going into a relationship, then yes I believe they should disclose.
If you’re just looking for a hookup at a bar and don’t care about any of the person’s other ancient history, then you shouldn’t care about this either.
However, if someone still has their primary sex characteristics and the only thing that they present as gender identifying is clothes, for example, then yes I think it’s criminal sexual assault to mislead a person into having sexual contact and not disclose that’s you’re still physically the sex you were born with.
But there’s a high bar for proof in that case. You can’t just say someone mislead you because you regret the encounter. Women are held to that standard, it shouldn’t be easier for men just because people have more animosity toward mtf transgendered persons.

Any action to force someone to accept the self proclaimed sexual identity of another, to the point of allowing homosexual activity to happen unknowingly, is a form of state sanctioned sexual assault.

If heterosexual male who finds sex with a male to be revolting or worse has sex with someone who represents them self to be "female" when they are a biological male and the biological male does not disclose this, it is a sex crime. END OF STORY.
