The 5th Amendment protects individuals from self-incrimination. It is clear about that.
IF, and this is important, IF it is a CRIMINAL case.
In a CIVIL case, which the NY lawsuit is, the Fifth Amendment does not forbid adverse inferences against parties to civil actions when they refuse to testify. In other words, used as, inferring guilt.
And just a reminder of what Trump said in 2016. “The mob takes the Fifth. if you’re innocent, why are you taking the Fifth Amendment?”

Is this the case that NY is bringing against Trump for supposedly over inflating the value of his properties?
I don't understand the damage that was done if he did?
Overestimating the value of a property brings higher taxes.
If he used this over inflation to secure loans then what is wrong with the bank that wouldn't send out its own appraiser to put a number on the property? What bank is just going to take a customers word? If that is the case how is this a Crime that Trump is responsible for?
If Trump is talking about the 5th amendment that is a standard response of his to so many witch hunts that he has had to endure.
Do we really care if Trump overestimated the value of his properties?
The allegations are fraud against his lenders. If you overinflate the value of your collateral you can qualify for larger loans and/or smaller interest rates on those loans.
