It doesn't mean it isn't a hate crime, it just means there is no evidence it is a hate crime. Just like any other crime, if there is no evidence, then legally it isn't a case.
Why would it be, if the motive is to steal from anyone with money.
Basically a hate crime is one where the only required motive is hate of people that are different (skin color, sexual orientation, etc...). That makes them unpredictable and random, since no provocation is necessary (as opposed to say someone flashing lots of money, which would make them a target of thieves wanting money).
But the selection of the target is based on skin color. How is that not a race crime? Attack is based on skin color with the added bonus of potentially more money.

How do you know the selection of the target is based on skin color? That's the point, unless you have evidence, you cannot confirm this. If someone yells racial statements, that is evidence.
Hating someone makes them unpredictable? That's BS. I hate dumb people, I hate rude people, I hate bums, I hate people who smell bad, I hate lots of people! That doesn't mean I'm going to go around committing crimes or doing unpredictable things. I know there are consequences, that makes my behavior predictable. People need to be punished for their actions, not their thoughts.

If I'm walking down the street minding my business and someone just attacks me from behind, but then yells racial slurs, that is clearly an unpredictable event.
I don't think it's a hate crime. How can we tell he wasn't just crazy as hell? If he would have attacked a fat white woman and called her a whale would it be a hate crime cause he targeted a fat person?

It is no more unpredictable than the attack on the bum, rude person, dumb person, etc. No, you can't control your race, but can dumb people control that they are dumb? Do rude people even know they are being rude?
Punishments for crimes make peoples behavior predictable. Just as there are people who hate a particular race, there are people who hate pretty much every group or label you can apply to people. Just because they don't like or even hate someone does not mean they are unpredictable. The fact that they will be punished if they commit a crime deters them. If not, then why did this guy just now commit this crime? Is this the first black person he has ever come across? Surely he has had opportunities to attack black people in the past if that is his motivation.
Crime should be equally punished. Thoughts and beliefs, as ridiculous as some of them are, must be protected to preserve our liberty.

That was the whole point of my post. That for it to be a hate crime I would have to vocalize my intent or utter a racial slur. But if I hate just as much and keep my mouth shut it's not a hate crime? I was pointing out the flaws in the law thats all.
Everybody needs to call your elected reps and DEMAND Federal Hate Crime charges against this racist conservative! The fact is (and I DO live in Georgia- this man will not spend a DAY in jail unless Federal charges are bought. In fact most of the locals down there probably approve of what he did which is why they did not interfere as she was stomped, kicked, called "dirty n***r" in front of her kid. Call the FBI too and DEMAND civil rights charges!!!

Now to the REAL issue. If this man did this then yes he should be charged and if convicted prosecuted to the fullest extent of the law. Poor woman she was just defending her child.
Hey are you going to be calling demanding hate crimes be charged against the black that just beat the white kid on the bus? We know all the other black kids on that bus was cheering. I guess they approved.

I don't care what the circumstances where, racial slurs or not, any man that beats a woman in front of their child deserves the worst. What I hate is the hate crimes laws which puts some above others. We are all entitled to EQUAL PROTECTION UNDER THE LAW.
