Most of those programs are only for the very poor. I fought for disability & lost, much to family's, friends & doctors amazement. It took many years. By that time I was 62 & went on early SS retirement.

Did you not have to sign something acknowledging that under both federal law and New Jersey law you would be subject to recovery ?

I would find it hard to believe you signed nothing acknowledging this..

I would think this is on par with taking a reverse mortgage and not understanding when the loan is due if you move they can take the house .

It has to be in something they gave you to sign, like this

disclosure:

“I acknowledge notice that the Division of Medical Assistance and Health Services (DMAHS) has the authority to file a claim and lien against the estate of a deceased Medicaid beneficiary, or former beneficiary, to recover all Medicaid payments for services received on or after age 55…

No I did not have to sign anything except the application each year. It is only in the last few years that It is CLEARLY stated that you may be liable to Medicaid Payback, It is now on the first page. This program was very deceptive. Why do you think more & more states have stopped collecting the Medicaid Recovery? It is CLEARLY AGE DISCRIMINATION

Those who are on Medicaid at the age of 26 will generally never have anything that can be recovered. Their method of life is exclusively to live off of taxpayers.

That is not the only reason they don't do it. It is just wrong in general, there are a lot of administrative issues with it, it doesn't net very much back for all the efforts and expenses (and heartbreak and stress for grieving families dealing with it).

Only 12 states do not do expanded Medicaid recovery out of all our states

This is simply not true. The OP is an example of someone who has something that can be recovered.
