I know of a friend who started doing airbnb as a living room thing, then entire place. He is not from chicago and has never owned a condo to understand how serious these HOAs are about their little laws. He realized how far they can go when they sent him a letter saying that his case will be heard by a resident board who will then decide what to do and how much fine to levy. They also attached "sections" of the how regulations which stated that they can charge him $1500 per DAY of short term rental. He is waiting to hear back. I agree that its better to own the land in a small multi unit property etc. so there are no HOAs involved. Period.

I must admit I think the fine was a little steep. It certainly is enough to stop someone in their tracks from doing this. I would not appreciated it if I lived in a condo that someone was doing airbnb because you don't really know who the people are that are renting for the night and they could be security risks.

Even in a single family house there are rules. In NY for instance, the owner must be present at time of rental. And if you are renting it our with owner not present it must be a lease of at least 30 days.

In fancy condos with doorman in Manhattan with strict policies it is very hard to do AIR BnB Plus it is all on camera, folks sign in and show license as ID.

In general folks like to say it is only friends and family, but when you get Black, White, Asian, Indian, French, Russian, Non English speakers from all over the world sleeping over, unless you are Charlie Sheen you are on the radar big time.

Since you broke a rule, you probably ought to have been kicked out. Next time you might not get off with just a fine.

You can't "kick" somebody out of a condo they own. Fines are the only way to go. If you fine them and they don't pay you can put a lien on their condo.

Since Chet didn't answer this question, can anybody else answer this question?

(Oh, and the fact that this thread is rebumped is not an excuse for people to answer the thread starter's question a couple years ago.).
