Is the Pope speaking infallibly by declaring the death penalty to be anti-Christian? (punishment, scriptures)

No human being is infallible, especially when it is about theology. One pope made eating meat on Friday a mortal sin; another pope eliminated it.



God instituted the death penalty(Gen 9:6) and it has not been revoked.
