The only thing that is consent to sex is a verbal confirmation of, "Yes, I would like to X, Y, & Z."

Obviously that was not meant to be literal... but X, Y, & Z to mean whatever sex acts were being consented to. Sorry if I was not clear enough about that, I assumed most people would understand.
"Yes, I want to have sex."
"Yes, I want to suck your _______________."
"Yes, I would love to be _______________ in the ___________________!"
Those are a few examples of what I meant by, "Yes, I would like to X, Y, & Z."
The main point was ONLY yes means yes. & the absence of a "no" does NOT mean "yes."

Well, it depends on what you mean by seemingly willing & seemingly enjoying. There is obviously non-verbal communication. The problem with it is that it can be easily misinterpreted.
Can a person who is willing to have sex still be raped? Absolutely. Because let's say you have consented to vaginal sex, does that automatically grant consent to all other forms of penetration? No.
What I am also saying is that being passive & never saying the word "no" is not the same as giving consent. Some people dissociate when they feel pressured for sex, some people may have felt they could not say no or that the person would not have cared if they did. People who are on drugs or drinking may be considered by law incapable of giving consent much in the same way a child/teen is considered incapable of giving consent even if they did say, "Yes!"
Technically there are only two ways to acquire consent:
1. You ask for it & the person responds in an affirmative way.
2. The person tells you what they want you to do.
For most people passion does tend to take its course -- but clearly that can present some major problems for those who cannot manage to take five seconds to obtain consent prior to penetration.
