They are both citizens and both deserving, but not the point.

Lopez can join the military and then get in-state in VA.

Most state statutes require proof of legal residence over a period of time (usually one year before admission).
I did try to read the article closely, it said he lived in Viriginia since he was a baby, and it said he was born in the US, however I didn't see where it said he was born in Virginia.

To qualify for 'in-state' tuition; all Lopez needed to do was live in Va. for 12+ solid months in a row.

If the Va. government wanted to be 'hardass' but fair, if the student had to wait an additional 12 months till his 19th birthday, than all doubt would be removed.
