I know for the noises and music, usually there is a time for which they can be enforced after 10 or 9 pm usually, until then loud music can be played and all the noise can be made and there is usually nothing which can be done.

I cannot say how the sheriff's office would respond to such a complaint. You can read the law and see what you think in your own mind.

For reference, here is the section of Montana Code Annotated that describes disorderly conduct.
[snip] So sounds like it's already covered. So the offended party just needs to go down to the sheriff's office and swear out a complaint.

Actually, I *know* you can do this, because I had a neighbour come over onto my place, steal stuff, and tease my dogs -- then he filed a complaint against them for barking. I was there first, YEARS before him, but that didn't matter -- the court forced me to get rid of my good watchdog, who was only trying to make sure I knew the thief was in sight. Funny how the dog only barked when this guy was out there teasing him or trespassing or stealing stuff. (BTW, this is that cop I later got fired for other misbehaviours, described in another post here somewhere.)

That was when I was living right next to the runway at the Belgrade airport. Er, noise?? hello??

From reading most the post here,i can see that everyone has a story of some kind ,but the main issue here seems to be to COUNTY ,and Flathead county. And all i can say is i did call the sheriff,as did i later found out several other in the neighborhood on this same guy.All they sill say is "we have no noise ordanence in the county, other than a barking dog"now what nim whit wrote up a law against barking dogs but thought nothing else was noise.either ya have a NO noise ordinence or ya dont.

Flathead County has no noise ordinance. In Montana, the cities and counties are only allowed to pass laws when authorized by the state, and the state has no law that allows the counties to regulate noise.

What the state has is a law that allows for arrest/citation of a person due to disorderly conduct. If the behavoir was severe enough to be considered disorderly conduct or disturbance of the peace, the sherriff's office is entitled to issue a citation. It would have to be a signficiant disturbance, but what jimj described may be considered disturbance of the peace.

And speaking of kids... what about my aforementioned idiot neighbour, whose baby would SCREAM for hours on end, at all hours of the day and night? Somehow that wasn't "noise", but my dog barking at this guy when he was trespassing was "noise".

I think I'm going to toodle on by the sheriffs office and ask them to explain why they won't enforce the disturbing the peace laws when it comes to fireworks outside the normal day(s). I'll let you know what they tell me besides get lost.

If you'd stop shooting, Debee's kid would get some sleep and stop screaming!

Just couldn't help that one....
