We've seen regulations like stores already refusing entry to people who aren't wearing shirts or shoes, and people who are smoking cigarettes.

Fortunately minorities are not shirt or shoe hesitant so I don't think your logic applies. It's also common sense regardless of race to not smoke indoors.
