I think the restaurant was set up. I mean really? Margarita is a very different flavor than apple juice, wouldnt the parents notice the child had a strange face. Or as few of you have mentioned, the parent should have checked first.
I have waited tables before and let me tell you, there are all types out there just looking for a free meal or a buck. And it IS Applebee's, not exactly "Fine Dining", so I can just imagine the kind of trash customers that go there.
A one-year old is still a baby. There is NO WAY the parents should have not known what their BABY was imbibing.
They did know their child wasn't acting right and they took him to the emergency room. That's how they found out their child was legally drunk.

They should lose their baby for taking them to an Applebee's? Talk about a police state that oversteps. There is no law against taking a child to a restaurants that serves drinks. It was a mistake, an accident, on the part of the restaurant. Why should the parents be held responsible for that?

I worked at one in Groton, CT....customers, TRASH. I attempted to eat lunch at one in Dallas, TX.....customers, GHETTO TRASH. I was talked into going to the one here in town, Waco, TX....customers, GHETTO & TRAILER TRASH.

I'm shocked because I've been in six different Applebee's---quite frequently---and they are all in upper-middle class neighborhoods and they attract a lot office type working people on their lunch hour or on their way home. I have never, ever seen trash behavior in any of their restaurants. Their prices are also not low enough to attract a lot of trailer trash types.
Simply suing over the loss or violation of a loved one is petty and greedy. I'd want some type of explanation or reasoning for it followed with an apology and a refund. No need to sue over that; however, if it was intentionally; I'd take legal action.

If your actions cause my toddler to become tipsy, I don't see it as unreasonable to sue.

What are you trying to get out of it though??? The fact that my child is fine and healthy is good enough for me [I have no kids though]. I feel no need to try and take advantage of the situation and get money out of it. That's just being greedy and selfish.
