uh, Gluten can't be airborn unless your living in a bakery or something

though technically, you could argue the same for peanuts

correct from what I know. My son isnt allergic to wheat. Peanut dust allergy is actually very rare.....that it why I wish more people would get frequently tested and see a true food allergy specialist to discuss this. There are tests that break down your body's reaction/resistance to each protein in milk, peanuts, eggs, etc.

There was one case in a nearby town when a girl was allegic to airborne peanut dust and she couldnt even go into the local grocery store where peanuts were sold in shells in bins without having a reaction. That is pretty rare (from what I know and studied). Now our son has never touched a peanut, so unsure of reaction there....though when he was younger he touched milk spilled at a daycare and it gave him blisters where he touched it on his fingers and hives on his face and back. No epi-pen needed but benadryl took care of it. Over the years our allergists through testing and measuring IgE and Ig4 levels indicate he would have to ingest the allergen to have an issue.

The whole world of food allergies and reaction is very complex and can vary so much from one person to the next and change over time. Parents and the young adults should always use extra caution and have medicine with them. It is unfortunate in this case, as I am assuming they knew he didnt have the medicine with him but decided to try something anyhow, esp considering his sensitivity was apparently very low.

Very tragic but isn't this on the parents not the resturant ?

First off if he was that allergic to dairy (which is pretty much everywhere) would they be more deligent on what he ate ? And if eating out was something not normally done would they have precautions thought out , just in case ? No Epipen (sp) , or any kind of emergency type of plan ? The only way this could be a lawsuit is if the Chef lied about the food being safe. Although in our litigious society I'm sure the family will be awarded millions.

If it's not your personal responsibility to monitor and adjust your family lifestyle choices when dealing with a severe allergy and having any number of close call warnings; I guess choices such as going to restaurants where anything and everything CAN happen, without taking safety medical equipment like epipens etc., along must be someone else's responsibility, eh?

Stupid family now has to deal with the loss of a loved one through THEIR negligence, no one else's.

If they win this lawsuit, I would advise all restaurants to never serve people with such allergies in the future. It's just not worth the risk.

Although in some ways, I can understand why the family HAD to sue the restaurant. From a psychological standpoint, it's too much responsibility for the parents to bear if they had to concede that their irresponsibility had caused their son's death.
