There's a real poll out on this now (WAPO/ABC) and the numbers are pretty close to this C-D poll. A strong majority are opposed to Trump declaring an emergency and less than 1/4 believe that there is a national emergency at the border. A comfortable majority continue to oppose a wall at all, and most, by far, blame the GOP and Trump for the shutdown.

These phony crisis declarations and a subsequent use of power through the use a national emergency is straight out of the handbooks of authoritarians and dictators. In 1933 during the old German Weimar Republic a rising Adolph Hitler used something similar called an Enabling Act to circumvent the normal channels of government and make himself the absolute source of power as the Nazis took control of the nation.

I would bet, even if Trump did this, many many people would still be obedient and compliant.

But for those on both sides this has become a point to poke the other in the eye.
Those in power dont want anything that may be too effective though, when it comes to illegal immigration, something truly effective would end up being bad for employers who depend on cheap labor, the same way, if the flow of illegal drugs was stopped or even slowed down, that would be a disaster for many LE agencies....its really all about doing something that 'APPEARS' to be effective (but not really).

If it was such a national emergency wouldn't he have just declared it back on Saturday, December 22nd, 2018?

Maybe it's one of those really slow emergencies!

Congress should declare a state of emergency to remove Trump from office. He is a spy. Here to cause chaos and enrich himself. Congress will not give a dime to the enemy in the WHouse. Cuff him . Then we can make America Great Again.

Maybe if there was a clear conservative majority on the court I would be more supportive of emergency powers.
The courts have zero say if he declares an emergency. The only way it can be overridden is a 2/3rds Senate majority. There has been significant incorrect reporting on this by the media.

If trump doesn't know if he should declare a state of emergency for the wall, there is no emergency.

Explained best in this video.

Now Lindsey Graham, one of Trump's biggest supporters for the wall, is now backpedaling. Graham knows, like Mitch McConnell and other senior republican congressman, that Trump declaring a SOE now could cause nightmares for the republicans in the future.

But Trump is short-sighted and ignorant, he doesn't care about any future consequences of his actions.
