The very question and the choices you gave prove you know zero about what capitalism, socialism, communism are! Go read up on what these are, then get back to us.
Excuse me for being Communist, Socialist or whatever. I'll take my HOA despite some abuses and flaws. We have friends, relatives and others who live in older communities and the unregulated crap that some neighbors do can make your living experience miserable.
How about backyard car repair shops with disassembled vehicles in various states of repair. Oil slicks and engine blocks. One guy across the street from my cousin has a huge electrified peace sign on his roof. And the rental property next door that has ten occupants and takes up every curbside parking space and blocks your mail box.
I went to visit some really cool unique homes last wknd. I suspect much of what I saw would not be allowed in most HOAs. That is a major problem for me, the generic nature of HOA communities beyond just keeping them up for the sake of property values.
I would have to take my chances at having a lousy neighbor before I could give up my ability to have the freedom to create a pond or fountain or a wildflower garden or put my friend's sculpture art in my garden. I wonder how much of what is in Better Homes and Gardens or Southern Living would not be allowed in many HOAs, probably plenty at least based on the HOA hoods know about.
I live in another country and yes HOAs have found their way here. I visited someone last night that I had met a few weeks ago. Gated community, nice looking properties and a HOA.
This community is mostly composed of people from Finland, Sweden and Norway. The HOA board is 5 members. Evidently over here you can opt out. You pay the maintenance fee and thats it. My acquaintance is slowly being seduced by the board to join. LOL The president of the board looks just like the evil emperor from Star Wars. LOL. Complete with tobacco stained fingers and uneven worn and stained teeth.
While I was there, the discussion they were having with my friend was about buying new garbage cans because everyone having there own created an eye sore. The HOA would buy large yellow cans and put them in strategic locations throughout the neighborhood. This would be where the homeowners would bring their household waste. The locations of course near non-member houses. The joke was let them deal with the stench of the garbage cans, truck, and the dogs that come to eat the trash.
I am a long time unpaid officer of my self- managed HOA of single family homes.
The association is collectively and equally owned by the homeowners. Like government, it is a democratic republic. Any owner can run for election and owners elect board members.
We respect owner private property rights. No gates. Roads are municipal. No rules about behaviors.
The assessment funds the operation , maintenance, repair and replacement of common assets, Lake, Pool, Tennis etc. Social activities, sport teams, lessons are all pay for use.

Zoning laws...... Deed restrictions.... These make your points moot. Buyer beware.
My land was close to 10 acres. I wasn't allowed a private business. Zoned residential. I wasn't allowed to build apartments. Deed restriction. I wasn't allowed a trailer. Deed restriction. I was allowed 1 unregistered vehicle.
Odd but no one turned the area into a crap hole. Although the Jersey Transplants always seemed to be feuding with each other. None of us natives could figure that out.
I will never live where a board comprised of people I dont know, have the power to dictate whether or not I fly our nations flag in conjunction with the flag of my service. I dont want some self congratulating pompous nobodies dictating to me, how to landscape my property, where I park my vehicle, at the curb or in the driveway or in my garage. Im sorry but you can hide in your HOA and be scared that every non-HOA neighborhood is a ghetto, but the reality is, most neighborhoods are nice places to live, without the NAZI overlords controlling them.
I look at them more like insurance. You buy in and agree to follow the rules to insure against the neighborhood turning into something it wasn't when you bought.
My HOA has no rules, thus no fines. It respects private property right.
