My interpretations are merely realistic. I am not so naive as to believe you give a hoot about my inner peace. It's a meaningless and disingenuous statement, that people make in order to assert their own supposed moral superiority.
Of course not. Statistics are not all wrong but there are cases where they can be manipulated and who's to know which ones?
It's very easy to know. If we say that more than 50% of contested custody cases are won by fathers, that is just that.
Statistics are manipulated when people are invited to make inferences that the statistic itself doesn't support. For example, the fact that this country has a 46% divorce rate doesn't mean that every couple has a 46% chance of divorcing -- since the rate varies widely depending on the age and economic status of the parties, the number of prior marriages, etc. Similarly, the fact that the mother gets custody in the overwhelming majority of cases doesn't mean that women win most contested custody cases -- since not every custody arrangement is contested, and in fact, very few are.
*Gender Bias Study of the Court System in Massachusetts, 24 New Eng.L.Rev. 745, 747, 825, 846 (1990) -- study which found that courts are more demanding of women and more lenient towards men in contested custody cases; male violence towards their wives was often held irrelevant to the issue of custody. This study also found that a whopping 94% of fathers who actively sought custody received joint or sole custody. Although fathers received physical custody in 29% of all cases, mothers received custody in only 7% of contested cases.
Per the executive summary:
"Fathers who actively seek custody obtain either primary or joint physical custody over 70% of the time."
Not 94% of the time. Also note that the 70% figure includes both primary and joint custody. In other words, mothers recieve FULL physical custody 30% of the time in contested cases.
Can only speak for myself. But in general men are procrastinators, I believe, so women must take the initiative. Women file becasue they are tired of being unhappy , tired of the BS and not getting needs met by a selfish man. They realize that they have a chance at happiness and they run to take it.
