I he WEREN'T drunk, asking for a blood test would've settled the matter. So, since he didn't request the blood test, it is pretty obvious WHY he didn't.

I hope they followed through on the mandatory blood draw for the weekends around here, like everyone else would have to do in the case that they get pulled over.

Actually, it depends. If he is a Type 2 diabetic, then very likely no (I checked - he's not - he's Type 1). In Type 1 diabetes, however, - a very different condition from Type 2 - alcohol has a paradoxical effect of lowering one's blood sugar. That happens because alcohol is metabolyzed by the liver, and that can interfere in the liver's dumping of sugars into the blood. In most people, this is not a problem - the body just slows down the production of insulin. However, in Type 1 diabetics with basal (and perhaps) bolus insulin on board, the combination can be problematic and result in a catastrophic low which can be mistaken for intoxication. For that reason, many Type 1 diabetics do not drink alcohol. Of course, the real question is what he blew on the brethalyzer or whether they administered a blood test to him and the results on that. If he was over the legal limit, then he was over the limit. Period. However, if the charge is based on the mere appearance of intoxication, then he may be telling the truth.
