Yes -- the states impose the actual administrative cut-off dates that are usually the Saturday immediately preceding the cut-off dates set by law.
If the November 30, 2010, is the eligibility cut-off date enacted by law, the actual cut-off dates imposed by the states for administrative purposes will be: November 20/21, 2010 - November 20 will be the last date you can exhaust regular unemployment benefits in order to be eligible to begin Tier I no later than November 21.
November 27/28, 2010 - November 27 will be the last date you can exhaust a Tier in order to be eligible to begin the next Tier no later than November 28.
Will the state of NY then continue to pay Extended Benefits if and when this bill passes? I would think so since (EB) would be 100% funded again until November 30, 2010.
There are two different bills in play in the Senate that would extend the eligibility cut-off dates for certain federal unemployment benefits: HR 5618 and HR 4213.
HR 5618 -- which I reported on in a previous post above -- is the stand-alone bill that passed by the House before the recess. At this stage it would require only a simple majority to pass the Senate -- provided Reid does not call for cloture on the bill and the Senate does not amend the bill.
HR 4213 -- the last of the Tax Extenders bill that has been kicking around Congress for many months -- includes more programs than just federal unemployment benefits. At this stage, this bill does require 60 votes to be passed. It is this bill (HR 4213) that Reid has said he will not move on until the late Senator Robert Byrd's seat is filled and the Democrats have the final vote they need for passage.

If extended, the last week of my Tier 3 will be the week ending 11/27. Does this mean I will be able to go to T4 (if PA triggered).?
4213 is DEAD! No Republican will vote for it in its current form. Adding 1 Democrat will not pass this bill. The Unemployment bill has 2 Republicans. 4213 has N-O-N-E!
Neither HR 5618 nor HR 4213 would extend the eligibility cut-off date for the FAC payment. However, although the eligibility cut-off date for the $25 weekly FAC payment has expired -- the program continues for those who had qualified beforehand.
If you filed a claim for regular unemployment benefits on or before May 23, 2010, you are still eligible to continue to collect the $25 weekly FAC payment through April 2011 (or until your last unemployment payment, whichever comes first).
So, if HR5618 is passed, everyone were receiving $25 before 5/23, will continue receiving it?
